Hi,

I'm hoping you can give me some answers.

We've recently been receiving numerous phone calls from what we assume is a collection agency, inquiring about our daughter who no longer lives here, and hasn't for the past three years. We do not know what this concerns and will not give out information over the phone. Evidently, if they have our home address and phone number, then it must have been a debt incurred while she was living with us. We've passed the information on to our daughter. The caller said that he can continue calling us because our address and phone number is listed on the reference sheet that he has. He also stated to my husband that the bill could have been paid for the price of the phone call (whatever that means because it's an 800 number).

• What information is appropriate for us to give to this caller?
• Can they continue to call and harass us, even though we've asked them to never call our phone again?
• (We have not co-signed any outstanding loan)

I found this phone number online and discovered it is Creditors Financial Group, LLC in Aurora, CO, phone number 888-298-7107.

My Answer:

I'm no lawyer, but it sounds like you can get this debt collector on some violations of the debt collection laws.

My undertanding is that once you've asked them not to call, they are supposed to respect that. To do anything else is phone harrassment. Even your daughter, if she is actually the debtor, can request that they cease phone contact and only use the mail.

I would give them no information whatsoever.

I've heard Bud Hibbs on some of the night time AM radio talk shows, and he really seems to know his stuff. He's got some contacts with lawyers that enjoy eating these kinds of debt collectors for lunch.

As for telemarketing laws, which might apply to the repeated calls from this agency, check out http://www.galwaycommunications.com An aggressive telemarketer claimed this was the address of their website, but they had not registered the domain name... A day later this website appeared telling people how to avoid their tactics. They don't seem to have noticed, it appears they still give out the domain name! Spread the word, help put an end to these nuisances!
